ÂN-BASSADOR Agreement

Welcome to ÂN-BASSADOR, our ANFISA Skin affiliate program! We're excited to have you join our community. At ANFISA Skin, we value transparent and genuine connections with our customers and partners. This ÂN-BASSADOR Agreement (the "Agreement") clearly outlines our shared understanding, ensuring compliance with Federal Trade Commission (FTC) regulations and maintaining the trust our customers place in us.

By enrolling in and participating in our program, you agree to these terms. Please review them thoroughly. We've aimed to make this as straightforward as possible.

We may change this Agreement at any time upon notice to you via the following URL: https://anfisaskin.com/pages/affiliate-agreement. 

 

1. Your Partnership with ANFISA Skin

This section explains the foundation of our collaboration.

  • What is an Affiliate Relationship?

    • An affiliate relationship is a partnership where you, as an ANFISA Skin Affiliate, introduce our skincare products to your audience. In return, you earn a commission on sales generated through your unique link. This might include sharing your experience on your blog, through social media, or other digital platforms. We do not require you to post, say specific wording, or dictate when or where to post.

  • Becoming an ANFISA Skin Affiliate

    • To join our ÂN-BASSADOR program, you must apply through our dedicated affiliate portal. We’ll review your application and notify you of our decision. We reserve the right to accept or decline applications at our sole discretion, ensuring alignment with our brand values. Once approved, you are responsible for maintaining the confidentiality of your affiliate account credentials and for all activities that occur under your account.

 

 

2. Your Role as an ANFISA Skin Affiliate: Guidelines for Success

As an ANFISA Skin Affiliate, your genuine representation of our brand is paramount. These guidelines ensure our partnership is always clear, honest, and compliant with all applicable laws and regulations, especially those from the FTC.

  • Upholding Legal Standards

    • Your promotional activities must always adhere to all relevant federal, state, and local laws, regulations, and guidelines, including the FTC's rules concerning endorsements and testimonials.

  • Honest & Accurate Representation

    • You must promote ANFISA Skin’s products truthfully and accurately. We encourage sharing your authentic experiences, but you must avoid any misleading or false statements about our products or their effects.

  • Use of Approved Materials

    • To maintain our brand's sophisticated aesthetic, you must use only the promotional materials that ANFISA Skin provides or specifically approves. You may not alter or modify these materials without prior written consent.

  • Prohibited Marketing Practices

    • You must refrain from engaging in prohibited marketing practices, including, but not limited to, spam, paid search advertising using ANFISA Skin’s trademarks (unless specifically approved in writing by us), or any form of deceptive advertising. Our aim is to always present our brand with integrity.

  • Important Note on Product Claims: No Drug Claims

    • ANFISA Skin products are luxurious cosmetics, crafted to enhance and nurture the skin. They are not intended to diagnose, treat, cure, or prevent any diseases or medical conditions. Therefore, you must refrain from making any "drug claims" about our products.

      • Do Not Claim:

        • “This product healed my skin.”

        • “This product cured my acne.”

        • “This product stopped my rosacea flare-ups.”

      • Instead, Focus On Describing Your Experience and Product Benefits:

        • “My skin feels incredibly smooth after using this product.”

        • “My complexion appears calmer and more even-toned since I started using this.”

        • “This product helps my skin feel beautifully hydrated and refreshed.”

  • Transparency: Your FTC Disclosures

    • Transparency is a cornerstone of our brand. For every piece of content where you promote ANFISA Skin products or use your affiliate links, you must clearly and conspicuously disclose your affiliate relationship with us. This is a vital FTC requirement.

      • How to Disclose:

        • Clear and Conspicuous Language: Use terms like "Ad," "Sponsored," "Paid Partnership," or relevant hashtags such as #ad or #ANFISASkinAd. Make sure the disclosure is easy to see and understand.

        • Prime Placement: Your disclosure must appear early and visibly in your content. Do not hide it behind “read more” links, at the very end of lengthy posts, or in tiny print.

      • Examples of Effective Disclosures:

        • "As an ANFISA Skin affiliate, I earn a commission on purchases made through my link."

        • "I received this product as part of my affiliate partnership with ANFISA Skin."

        • "Sponsored by ANFISA Skin #ad"

  • Platform-Specific Disclosure Guidance

    • Different platforms have their own nuances for disclosures. Please follow these guidelines to ensure compliance everywhere you share:

      • Social Media Posts (e.g., Instagram, Facebook): Include the disclosure within the first few lines of your caption. Use a recognizable hashtag like #ad or #adforANFISASkin.

      • Videos & Podcasts (e.g., YouTube, Spotify): Verbally state the disclosure clearly near the beginning of your content. Also, include the disclosure prominently in the video description or show notes.

      • Short-Form Content (e.g., TikTok, Instagram Reels, X/Twitter): Use clear, concise language and appropriate hashtags to ensure the disclosure is understood within character limits. Consider adding a text overlay for visual clarity if applicable.

      • Blog Posts & Websites: Place the disclosure at the very beginning of the post, before any product mentions or links.

  • Honesty and Authenticity

    • You must maintain honesty and accuracy in all your reviews and endorsements of ANFISA Skin products. Share only your true experiences, and avoid making false or unsubstantiated claims about product results, prices, or promotions. You must consistently disclose your affiliate status every time you share an affiliate link or mention ANFISA Skin products.

 

 

3. Commission and Payment Details

Let's discuss how you'll be compensated for your efforts!

  • Commission Structure

You will earn a commission based on sales generated through your unique affiliate links. The commission rate ranges between 10%-40% of the net sale amount (excluding shipping and taxes). Your commission rate is based on the ÂN-BASSADOR tier you are in. Tiers are determined based on the number of sales generated every quarter.

  • Payment Schedule

Payments are automated and commissions are paid every 30 days starting from the date your first sale is made.

  • Payment Methods

Affiliates will be guided through setting up their payment account by logging into their Collabs Creator account and clicking on the Payouts tab. Here, the affiliate will be able to activate auto-payouts by inputting their personal and billing information. This will be used to create a PayPal Hyperwallet account, which is how creators get paid. Automatic payments ensure the money gets into the Affiliate’s Collabs account and is ready to cash out to their preferred payment method.

  • Refunds and Returns

Commissions are tied to completed sales. If a customer returns a product or a sale is refunded, the commission earned from that sale will be deducted from your future payments.

 

 

4. Intellectual Property

This section covers your right to use our brand elements.

  • License to Use ANFISA Skin Materials

ANFISA Skin grants you a non-exclusive, non-transferable, and revocable license to use ANFISA Skin’s trademarks, logos, and approved promotional materials solely for the purpose of promoting ANFISA Skin’s products as part of this Agreement.

  • Restrictions on Use

You may not modify, alter, or create derivative works from ANFISA Skin’s intellectual property. You must not use ANFISA Skin’s trademarks in a way that suggests endorsement or partnership beyond this affiliate relationship.

 

 

5. Term and Termination of Our Agreement

This section covers the duration of our partnership.

  • Agreement Duration

This Agreement begins once ANFISA Skin accepts your affiliate application and continues until terminated by either party as described below.

  • Termination Rights

Either you or ANFISA Skin may terminate this Agreement at any time, with or without cause, by providing written notice to the other party.

  • Effect of Termination

Upon termination, you must immediately cease using all ANFISA Skin intellectual property and promotional materials. Any outstanding commissions earned prior to the effective date of termination will be paid out according to the Payment Terms outlined in Section 3.

 

 

6. Your Commitments to Us

By becoming an ANFISA Skin Affiliate, you represent and warrant that:

  • Legal Capacity: You have the legal authority and capacity to enter into this Agreement.

  • Compliance: Your promotional activities will fully comply with all applicable laws and regulations.

  • Ethical Practices: You will not engage in any fraudulent, misleading, or unethical practices to generate sales or commissions.

 

 

7. Limitation of Liability

ANFISA Skin shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with this Agreement or the Affiliate Program. In no event shall ANFISA Skin’s total liability exceed the total commissions paid to you in the preceding six (6) months.

 

 

8. Indemnification

You agree to indemnify, defend, and hold harmless ANFISA Skin, its officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses arising from:

  • Breach of Agreement: Your breach of any term of this Agreement.

  • Legal Violations: Your violation of any applicable laws or regulations.

  • Misconduct: Your negligent or willful misconduct in promoting ANFISA Skin’s products.

 

 

9. Governing Law and Dispute Resolution

  • Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of [Your State, e.g., California], without regard to its conflict of law principles.

  • Dispute Resolution

Any disputes arising out of or related to this Agreement shall be resolved through binding arbitration in [Your City, State, e.g., Los Angeles, California], in accordance with the rules of the American Arbitration Association.

 

 

10. Updates to This Agreement

ANFISA Skin reserves the right to modify or update this Agreement at any time. We will notify you of significant changes via email or through the affiliate portal. Your continued participation in the Affiliate Program after such notification constitutes your acceptance of the updated terms.

 

 

11. Entire Agreement & Severability

  • Entire Agreement

This Agreement represents the complete understanding between you and ANFISA Skin regarding the Affiliate Program and supersedes all prior or contemporaneous understandings and agreements, whether written or oral.

  • Severability

If any provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

 

 

12. Compliance Guidelines

As an affiliate of ANFISA Skin, you must follow these guidelines to remain compliant with Federal Trade Commission regulations.

  • No Drug Claims:

Do not claim that ANFISA Skin products treat, cure, or prevent any diseases or medical conditions. These products are cosmetics, not medical treatments.

  • Examples to Avoid:

    • “This product healed my skin.”

    • “This product cured my acne.”

    • “This product stopped my rosacea flare-ups.”

  • Examples to Follow:

    • “My skin feels smoother after using this product.”

    • “My skin appears calmer and more even-toned.”

    • “Improves texture and minimizes the appearance of temporary redness.


  • FTC Disclosures:

Always make your affiliate relationship clear and conspicuous (easy to see and read). Disclose it early and visibly in any promotional content, such as social media posts, blog articles, videos, or emails. Do not hide the disclosure behind a “read more” link, at the bottom of a lengthy post, or only in fine print.

  • Examples:

    • “As an affiliate of ANFISA Skin, I earn a commission on purchases.”

    • “I received this product as part of my affiliate partnership.”


  • Platform-Specific Guidance

    • Social Media Posts: Include the disclosure within the first few lines of your caption. Consider using a recognizable hashtag (e.g., #ad, #adforANFISASkin, #sponsored, #advertisement) along with the full disclosure statement.

    • Videos and Podcasts: State the disclosure verbally near the beginning and include it in the video description or show notes.

    • Short-Form Content: Use clear language and appropriate hashtags to ensure consumers understand your relationship with ANFISA Skin even within character limits. 


  • Honesty and Accuracy

Be truthful in your reviews and endorsements, sharing only your genuine experiences. Avoid misleading statements about product results, prices, or promotions. You must disclose your affiliate status every time you share an affiliate link or mention the product.
